Definitions applied to this Agreement:

Agreement : the whole of this document.

The Company : ‘Bright Buy Ltd' Registration No: 05935080 or any of its trading styles.

Service Provider : A developer, individual, agent, sole trader or company who sell Investments or a regulated broker or company who sell Mortgages.

Investment(s ): For the purposes of this agreement an Investment shall be defined as property and/or land.

Mortgage(s ): For the purposes of this agreement a Mortgage shall be any product defined as a Mortgage by the FSA.

Advice : For the purposes of this agreement advice shall mean any action that is regulated by the FSA.

Client(s ) : the consumer for whom the sale of Investments or a Mortgage is arranged.

Commission : a percentage fee or an agreed fee received by The Company from a Service Provider for current and future Mortgage and/or Investment sales to a referred Client.

Reservation Fee: a fee received from the Client for reserving a property we advertise on behalf of a Service Provider.

Representative(s ): any person with the power to form a binding arrangement on behalf of The Company.

Lender : any FSA regulated company/bank/building society with whom a Mortgage is agreed.

 

Terms and Conditions:


1) Please note that the property prices shown on this website and in our promotional material are not a valuation as we are not qualified surveyors.

2) THE PROPERTY MISDESCRIPTIONS ACT 1991
The Company has not tested any apparatus, equipment, fixtures and fittings or services and so cannot verify that they are in working order or fit for purpose. A buyer is asked to obtain verification from their solicitor or surveyor. References to the Tenure of a Property are based on information supplied by the seller. The Company has not had sight of the title documents. A buyer is advised to obtain verification from their solicitor. Items shown in photographs are NOT included unless specifically mentioned within the sales particulars. They may however be available by separate negotiation. Buyers must check the availability of any property and make an appointment to view before embarking on any journey to see a property.

4) The Company is not providing financial, legal or tax advice under the regulations of the Financial Services Authority, and any statements referring to these subjects are to be considered opinion only. The Company uses all reasonable efforts to ensure that the property information published here and elsewhere is accurate, current and complete at the date of publication; no warranties or representations are made or implied as to the accuracy of such information.

6) Neither The Company, nor any of its employees or representatives will be liable for damages arising out of or in connection with the use of information provided. Nor will they accept responsibility, to the extent permitted by law, for any errors, omissions or inaccuracies in any of the information of any kind, nor for any loss arising from the use of, or any action taken in reliance on, any information appearing on the website and elsewhere.

7) We may contact you in the future by means of an unsolicited promotion should we wish to contact you to discuss the relative merits of an investment or service which we feel may be of interest to you.

8) The Company acts only as an introducer to Service Providers. We do not directly sell any Investments. The Client will use the Service Providers introduced by The Company to proceed with an Investment purchase.

9) Certain factors may affect our brokers ability to offer a fee free service. As an Introducer, we will receive a fee of 50% of the commission (procuration fee) received by the mortgage broker firm from the lender; for introducing customers who obtain a mortgage loan. The Company is a separate company and act only as the introducer to our regulated mortgage brokers. We are currently not regulated to give mortgage advice or offer mortgage products.


10) The Client may not alter or vary the terms of the contract provided by The Company without written permission of The Company.

11) The Client shall have no authority to enter into any negotiations with a Service Provider to change, alter or
restructure the deal as stated/published by The Company.

12) The Client shall have no authority to agree a price/discount different than the list price/discount level as published by The Company without the prior written agreement of The Company.

13) The Client shall not, either on his/its own behalf or on behalf of any other firm or company or party; contact
or be involved directly or indirectly with the Service Provider of the introduced properties, or any other party acting for the Service Provider without the prior written agreement of The Company.

14) All contact at property sites must be conducted by prior arrangement with The Company or a recognised Service Provider or agent.

15) No Client shall approach the Service Provider or enter into negotiations for a property purchase on behalf of The Company.

16) All information relating to any deals offered to a Client by The Company is strictly confidential.

17) If the property is let, the Client will pay for the cost of any flooring, furniture and window dressing that is
required.

18) Reservation Fees are non-refundable unless the property is withdrawn from sale. All Reservation Fees are transferred to a Service Provider upon receipt and the Client will have no further claim against The Company for these funds once they have been transferred.

19) The Company encourages Clients to carry out their own due diligence. Prior to payment all Clients must satisfy themselves as to the suitability of the investment.

20) Upon legal completion The Company will have no further claim on the property.
